-webkit-text-size-adjust: auto;"><font color="#808080">         2017年7月，西寧市城中區(qū)人民檢察院以西寧市城中區(qū)人民法院對(duì)西寧市總寨逸夫小學(xué)副校長(zhǎng)田發(fā)洪猥褻兒童一案無(wú)罪判決適用法律錯(cuò)誤、事實(shí)及證據(jù)認(rèn)定有誤為由，向西寧市中級(jí)人民法院提出抗訴。2017年11月，西寧市中級(jí)人民法院經(jīng)審理采納西寧市人民檢察院支持抗訴意見(jiàn)，依法對(duì)田發(fā)洪以犯猥褻兒童罪改判為有期徒刑3年。本案中，田發(fā)洪利用其違規(guī)開(kāi)辦補(bǔ)習(xí)班之機(jī)，多次猥褻補(bǔ)習(xí)女學(xué)生，嚴(yán)重傷害了涉案未成年被害人的身心健康。</font></h3><p style="font-family: -webkit-standard; -webkit-text-size-adjust: auto;"><font color="#808080">         田發(fā)洪一案并非個(gè)案，2018年3月，海東市互助縣人民檢察院辦理的互助縣丹麻鎮(zhèn)索卜灘小學(xué)員工魯發(fā)光猥褻兒童案，魯發(fā)光利用其宿舍管理員的身份，以檢查學(xué)生宿舍為由，在2016年5月至6月兩個(gè)月時(shí)間內(nèi)對(duì)住校的14名不滿14周歲的女生進(jìn)行猥褻，造成極為惡劣的社會(huì)影響。經(jīng)檢察機(jī)關(guān)提起公訴后，法院判處魯發(fā)光有期徒刑5年。</font></h3><p style="font-family: -webkit-standard; -webkit-text-size-adjust: auto;"><br></h3> <p style="font-family: -webkit-standard; white-space: normal; -webkit-tap-highlight-color: rgba(26, 26, 26, 0.301961); -webkit-text-size-adjust: auto;"><font color="#808080"><span style="-webkit-tap-highlight-color: rgba(26, 26, 26, 0.301961);">        2017年，海東市平安區(qū)第一中學(xué)學(xué)生王某某與張某某因列</span>隊(duì)問(wèn)題發(fā)生矛盾，王某某叫上同同學(xué)星某某、郭某某，將張某某約到男生廁所內(nèi)進(jìn)行毆打，在毆打過(guò)程中，張某某持刀捅傷郭某某，郭某某經(jīng)搶救無(wú)效死亡。此案正在審理中。</font></h3><p style="font-family: -webkit-standard; white-space: normal; -webkit-tap-highlight-color: rgba(26, 26, 26, 0.301961); -webkit-text-size-adjust: auto;"><font color="#808080">       從2016年以來(lái)全省檢察機(jī)關(guān)辦理的未成年人犯罪案件和侵害未成年人犯罪案件情況看，共受理審查起訴校園暴力和欺凌案件119人，其中發(fā)生中學(xué)生之，間的校園暴力與欺凌犯罪74人，校外人員在校園及周邊侵害未成年人犯罪案件45人。該類(lèi)案件多集中在西寧、海東兩市。共受理性侵未成年人犯罪案件5人，其中1起發(fā)生在校內(nèi)，2起發(fā)生在校外培訓(xùn)機(jī)構(gòu)，審查后均批準(zhǔn)逮捕和起訴。</font></h3><p style="font-family: -webkit-standard; white-space: normal; -webkit-tap-highlight-color: rgba(26, 26, 26, 0.301961); -webkit-text-size-adjust: auto;"><font color="#808080">       一是有的地方對(duì)幼教機(jī)構(gòu)、中小學(xué)校、職業(yè)技術(shù)學(xué)校學(xué)生保護(hù)和校園安全管理不到位。個(gè)別學(xué)校的負(fù)責(zé)人沒(méi)有真正擔(dān)負(fù)起校園安全管理的責(zé)任，對(duì)員工性侵學(xué)生的行為往往不能及時(shí)發(fā)現(xiàn)，導(dǎo)致犯罪行為在一定時(shí)間內(nèi)存在，且侵害多名未成年學(xué)生。</font></h3><p style="font-family: -webkit-standard; white-space: normal; -webkit-tap-highlight-color: rgba(26, 26, 26, 0.301961); -webkit-text-size-adjust: auto;"><font color="#808080">        二是對(duì)教職員工隊(duì)伍管理不到位。雖然人社部門(mén)、教育部門(mén)招錄聘用教師程序較為嚴(yán)格，但招聘過(guò)程中很難考察師德，特別是對(duì)招聘工勤人員要求不高，隊(duì)伍不穩(wěn)定，監(jiān)管有難度，教育培訓(xùn)、相關(guān)規(guī)章制度學(xué)習(xí)以及執(zhí)行力的督促檢查缺失。一些學(xué)校負(fù)責(zé)人、班主任和任課老師對(duì)學(xué)生之間可能發(fā)生的暴力或欺凌事件的苗頭發(fā)現(xiàn)不及時(shí)，重視不夠，缺乏及時(shí)有效的引導(dǎo)教育和糾正。</font></h3><p style="font-family: -webkit-standard; -webkit-text-size-adjust: auto;"><font color="#808080">四是對(duì)校外輔導(dǎo)培訓(xùn)機(jī)構(gòu)缺乏有效監(jiān)督。審批部門(mén)雖然制定了對(duì)校外輔導(dǎo)培訓(xùn)機(jī)構(gòu)監(jiān)督管理的相關(guān)制度，但對(duì)這些制度的落實(shí)監(jiān)督管理不到位，在聘用時(shí)程序簡(jiǎn)化，聘用人員素質(zhì)參差不齊，極易發(fā)生違法犯罪問(wèn)題。</font></h3><p style="font-family: -webkit-standard; white-space: normal; -webkit-tap-highlight-color: rgba(26, 26, 26, 0.301961); -webkit-text-size-adjust: auto;"><font color="#808080">      校園應(yīng)當(dāng)是最安全的地方，為未成年人構(gòu)建安全健康的成長(zhǎng)環(huán)境，也是全社會(huì)共同的重要職責(zé)。鑒于貴廳為全省教育主管部門(mén)，為進(jìn)一步推動(dòng)幼教機(jī)構(gòu)、中小學(xué)校和校外培訓(xùn)機(jī)構(gòu)安全建設(shè)，從源頭上有效預(yù)防和減少性侵害未成年人和校園暴力欺凌犯罪案件發(fā)生，根據(jù)有關(guān)法律規(guī)定，提出如下檢察建議:</font></h3><p style="font-family: -webkit-standard; white-space: normal; -webkit-tap-highlight-color: rgba(26, 26, 26, 0.301961); -webkit-text-size-adjust: auto;"><font color="#808080">      一是建議對(duì)照最高人民檢察院發(fā)送給教育部的《中華人民共和國(guó)最高人民檢察院檢察建議書(shū)》(高檢(2018) 1號(hào))，采取有效措施，推進(jìn)相關(guān)工作，共同推動(dòng)學(xué)校預(yù)防性侵害和校園欺凌工作不斷取得新成效，切實(shí)維護(hù)好校園安全和兒童、學(xué)生合法權(quán)益。</font></h3><p style="font-family: -webkit-standard; white-space: normal; -webkit-tap-highlight-color: rgba(26, 26, 26, 0.301961); -webkit-text-size-adjust: auto;"><font color="#808080">      二是建議按照省檢察院與省教育廳共同會(huì)簽的《關(guān)于開(kāi)展法治宣傳教育進(jìn)校園的意見(jiàn)》，進(jìn)一步完善和推進(jìn)法治副校長(zhǎng)機(jī)制，建立健全全省檢察機(jī)關(guān)檢察長(zhǎng)、副檢察長(zhǎng)兼職擔(dān)任轄區(qū)學(xué)校法治副校長(zhǎng)制度。常態(tài)化推進(jìn)“法治進(jìn)校園”工作，探索建立以檢察官、老師、社會(huì)工作人員為師資的法治教育實(shí)踐基地。在中小學(xué)校建立完善留守兒童關(guān)愛(ài)機(jī)制，加大親職教育力度。</font></h3><p style="font-family: -webkit-standard; white-space: normal; -webkit-tap-highlight-color: rgba(26, 26, 26, 0.301961); -webkit-text-size-adjust: auto;"></h3><h3><font color="#333333"><span style="-webkit-tap-highlight-color: rgba(26, 26, 26, 0.301961);">       三是進(jìn)一步加強(qiáng)校園安全管理。近兩年來(lái)，盡管我省性侵</span>未成年人案件只有5件，但從中反映出校園安全存在潛在風(fēng)險(xiǎn)，建議健全完善相關(guān)制度機(jī)制，如教師準(zhǔn)入、工勤人員準(zhǔn)入制度，安全隱患定期督導(dǎo)排查機(jī)制、校園安全風(fēng)險(xiǎn)防控機(jī)制等，及時(shí)消除隱患。加強(qiáng)教職員工師德師風(fēng)教育，聯(lián)合相關(guān)部門(mén)建立性侵害學(xué)生違法犯罪信息庫(kù)和入職查詢(xún)制度。健全完善侵害學(xué)生投訴和處理機(jī)制，切實(shí)規(guī)范學(xué)生宿舍管理，進(jìn)一步明確寄宿制學(xué)校女生宿舍管理由女性負(fù)責(zé)的要求。</font></h3><p style="font-family: -webkit-standard;
